Welcome to MomSchooler! These Terms of Service ("Terms") govern your use of the MomSchooler mobile application and related services (collectively, the "Service") operated by Pistacho Apps ("we," "our," or "us").

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 18 years old to create an account and use the Service. By using MomSchooler, you represent and warrant that:

• You are at least 18 years of age
• You are the parent or legal guardian of any children whose information you enter into the app
• You have the legal capacity to enter into these Terms
• You will provide accurate and complete information

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscriptions and Payments

4.1 Free Trial

We offer a 3-day free trial for new users. The trial provides full access to all features. No credit card is required to start the trial.

4.2 Subscription Plans

After your trial, you may subscribe to one of our paid plans:

• Smart Planning: $9.99/month or $99/year
• Complete Curriculum: $55/month or $550/year
• Lifetime Access: $1,999 one-time payment

4.3 Billing

Subscriptions are billed in advance on a recurring basis (monthly or yearly). Your subscription will automatically renew unless you cancel at least 24 hours before the end of the current billing period.

4.4 Payment Processing

Payments are processed through Apple App Store or Google Play Store. All payments are subject to their respective terms and conditions.

4.5 Refunds

4.6 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

5. Use of the Service

5.1 Permitted Use

You may use the Service for your personal, non-commercial homeschool planning purposes in accordance with these Terms.

5.2 Prohibited Use

You agree not to:

• Share your account credentials with others
• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Reverse engineer or decompile the application
• Remove any copyright or proprietary notices
• Use the Service to harm, threaten, or harass others
• Upload malicious code or content
• Resell or redistribute the Service

6. Content and Data

6.1 Your Content

You retain ownership of any content you create or upload to the Service (schedules, notes, etc.). By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you.

6.2 Our Content

The Service and its original content (excluding your content), features, and functionality are owned by Pistacho Apps and are protected by copyright, trademark, and other intellectual property laws.

6.3 Curriculum Content

The curriculum frameworks, skill progressions, and educational content provided in the Service are for planning and tracking purposes only. We do not guarantee educational outcomes.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy of any content or information

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PISTACHO APPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content
• Loss of profits or revenue
• Interruption of service
• Any errors or omissions in content

Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pistacho Apps, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

10. Termination

10.1 By You

You may cancel your subscription at any time through your device's account settings (Apple App Store or Google Play Store). You may delete your account by contacting us at [email protected].

10.2 By Us

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

10.3 Effect of Termination

Upon termination, provisions that by their nature should survive will remain in effect, including ownership, warranty disclaimers, indemnification, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the app and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pistacho Apps operates, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pistacho Apps regarding the Service.
